Official Rules

NO PURCHASE IS NECESSARY TO ENTER, WIN OR CLAIM A PRIZE. THIS SWEEPSTAKES IS OPEN TO LEGAL RESIDENTS OF THE CONTIGUOUS UNITED STATES ONLY (EXCLUDING NEW YORK AND FLORIDA) AND SHALL ONLY BE CONSTRUED AND EVALUATED ACCORDING TO UNITED STATES LAW. VOID WHERE PROHIBITED. 

I. WHO IS ELIGIBLE TO ENTER OR WIN: 

The Every Round of Ammo Ordered Gets You a Chance to Win a Gun Every Month Giveaway! (the “Sweepstakes” or “Promotion”) is open to legal residents of the contiguous United States and District of Columbia (D.C) (excluding residents of New York and Florida) who are at least twenty-one (21) years of age on date of entry and legally eligible to own and possess a firearm in their state or residence. Persons in the following categories are NOT eligible to participate: any person who on or after the beginning of this Sweepstakes was or is (a) a director, officer, employee, agent, or independent contractor of Webcorp Inc, dba Tactical Shit (the “Sponsor” and “Prize Supplier”); (b) a director, officer, employee, agent, or independent contractor of any entity engaged to assist with the creation, administration, advertising, or management of the Sweepstakes; or (c) an immediate family member (defined as spouse, IRS-dependent, or biological, foster, in-law, adoptive, or step-mother, father, sister, brother, daughter, or son) of, or who resides in the same household as, any person in any of the preceding categories. The Sweepstakes is governed by these Official Rules. Participation in the Sweepstakes constitutes a Participant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein.

II. SWEEPSTAKES PROMOTION PERIOD: The Sweepstakes begins at 12:00 am Eastern Time (“ET”) December 25, 2023, and ends at 11:59:59 pm ET December 31, 2024 (the "Entry Period"). Twelve monthly winner drawings will be conducted throughout the Promotion Period. Refer to Section IV of these rules.

III. HOW TO ENTER: A consumer is deemed a participant ("Participant" or “you”) in the Sweepstakes if eligible and enters the Sweepstakes using one of the following two (2) methods of entry:

1.) Purchase of Ammo Rounds Method of Entry: Visit https://shop.tacticalshit.com (the “Website”) to complete a purchase of the Sponsor’s Ammunition (“Ammo”) and to receive one (1) entry for each individual number of Ammo Rounds (“Ammo Rounds”) purchased. A purchase of Ammo Rounds comes in quantities from 3-Rounds Box to 1000+ Rounds Case. Follow the prompts to provide your full name, mailing address, date of birth, phone number (used for winner notification only), and email address. Agree to the Official Rules and confirm you are at least twenty-one years of age. All orders are required to be placed through the Sponsor's Website. The date that appears on the confirmation order Receipt (“Receipt”) determines eligibility of Sweepstakes entry per the number of Ammo Rounds purchased during the Promotion Period.  The name of the person appearing on the Receipt and/or signed purchase agreement is entered into the Sweepstakes database. Merchandise returned or canceled prior to the drawing date, will void the entry resulting in the removal of Participant from the Sweepstakes entrant list.

2.) Mail-in Method of Entry (AMOE): Enter by legibly hand printing on a 3”x 5” or 4" x 6" postcard or paper, in black or blue ink, your first name, last name, mailing address, city, state, zip, day and evening phone numbers with area code (to be used for winner notification), e-mail address (if available) and date of birth. Mail each postcard separately in a hand printed first class stamped #10 business size envelope to: Compliance / Ammo Ordered Gets You a Chance to Win, P.O. Box 468, Stonington, CT 06378. The return address on the envelope must also be hand-printed with the sender’s full name and address. Rubber stamped or commercial printed return address labels will void the entry. All mail-in entries must include all requested information and format (as stated above) to be considered a valid entry. Free standing postcards and bulk shipments (multiple entries in one shipping envelope) will not be accepted and will be destroyed. Mail-in entries must be postmarked between December 25, 2023, and December 31, 2024, and must be received by January 6, 2025. A correctly completed monthly postcard in a #10 envelope, receives fifty (50) entries into the random winner drawing. Mail-in entry card and envelope must be hand printed by the Participant only. Participants are not permitted to use any third-party organization to assist with the entry process in any way (as determined by the Administrator). Typed, computer generated, or otherwise mechanically reproduced postcards, and outer envelopes are NOT allowed and will not be accepted. Proof of sending an entry will not be deemed to be proof of receipt by Sponsor. Sponsor is not responsible for mail that is lost, late, incomplete, invalid, unintelligible, illegible, stolen, damaged, or misdirected. Postage due mail entries will be disqualified. Each Envelope must be mailed individually. Bulk shipments of entries will not be accepted. All entries become the exclusive property of Sponsor and will not be acknowledged or returned.

Limit: Five Thousand (5000) entries per person regardless of method of entry. 

Any attempt by Participant to obtain more than the stated number of entries by using multiple/different identities, email addresses and/or any other method will void that Participant's entry. In the event of a dispute regarding the identity of the person submitting an entry, the entry will be deemed submitted by the person in whose name the email account (provided via the Entry Form) is registered ("Authorized Account Holder"). The Authorized Account Holder is the natural person who is assigned to the email address by an internet access provider, on-line service provider, or other organization that is responsible for assigning email addresses, or the domain associated with the submitted email address.

IV. MONTHLY WINNER DRAWINGS AND ODDS: Beginning January 31, 2024, through December 31, 2024, a monthly Grand Prize Winner (“Winner(s)”) will be randomly drawn by a third-party administrator (“the Administrator”), an independent judging organization, whose decisions are final in all matters relating to this Sweepstakes. Each month’s potential Winner will be notified by phone and/or e-mail as supplied at time of entry. The notification will include instructions on how to contact Administrator to provide name, address or other information that may be necessary to complete validation of eligibility. If the potential Winner cannot be contacted or does not respond within two (2) calendar days of the initial notification, or does not respond with complete contact information as requested by voice message, or whose phone provider indicates that the phone number is invalid or unable to receive the communication (even if ultimately delivered thereafter), or found to be ineligible, cannot or does not comply with these Official Rules, or if his/her prize or prize notification is returned as undeliverable, such potential Winner will be disqualified and an alternate potential Winner may be selected at Sponsor’s sole discretion. All methods of entry have an equal chance of winning. Odds of winning in this drawing depend upon the number of entries received by the time of the monthly drawing. Each month’s eligible prizewinner will be featured on the Sponsor's Web Site. 

DRAWING DATES and NOTIFICATION SCHEDULE

NOTE: AMOE entries must be postmarked by the last business day of each month or AMOE Entry will be entered into following month’s drawing. Refer to Section VI below, regarding notification of winners for those who enter through the AMOE.

V. PRIZES (“Prize(s)”): Twelve (12) Grand Prize Winners will each be awarded a $500 Tactical Shit Gift Card that can be used for the featured Gun of the Month, or any other product(s) featured on the Sponsor’s website. Total Approximate Retail Value (ARV) of Prize Pool is $6000 (USD).

State and local laws, restrictions and regulations may limit or prohibit the sale, prize distribution, or use of certain Prizes. Certain Prizes may require the completion of Federal and State forms which must be completed and passed prior to distribution of the Prize. For Prizes that are firearms, Winner must be able to legally possess a firearm and may be required to complete all federal forms and pass all state and federal background checks.

VI. PRIZE ACCEPTANCE TERMS AND CONDITIONS: Each Grand Prize Winner is required to comply with all applicable federal, state, and local laws, rules, regulations, and is solely responsible for all federal, state and/or local taxes, or for any other fees or costs associated with the Prize received. To claim a prize, Prize Winner will be required to provide his/her correct full-name, mailing address, date of birth, telephone number and/or e-mail address, and proof of identification in the form of a Driver’s License within four (4) days of written notification or the Prize may be forfeited, and an alternate potential winner selected, time-permitting.  If a potential Winner fails to return requisite document within the specified time period, and/or if a potential Winner is not in compliance with these Official Rules, then such person shall be disqualified, and an alternate winner will be selected for the prize at issue. The proof of identification is subject to verification by Sponsor and all potential Winners are subject to verification before any prize will be awarded. No transfer of Prize will be permitted. Sponsor reserves the right, at its sole discretion, to substitute any Prize with another Prize (or cash equivalency) of equal or greater value, if the advertised Prize (or any component thereof) is not available.  All decisions by Sponsor as to the Winner and Prize are final. 

VII USE OF PERSONAL INFORMATION: By entering the Sweepstakes, Participant consents for the Sponsor to obtain, use, and transfer a Participant’s name, address and other information provided for the purpose of administering this Sweepstakes; the information provided in connection with the entry process will be used by Sponsor and Administrator only, in accordance and will not be sold or provided to another company. Participant’s entry information will be treated according to Sponsor’s privacy policy, https://shop.tacticalshit.com/privacy-policy/. By participating in the Promotion and providing any contact information, Participants hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s Privacy Policy. Prize Winner’s acceptance of a Prize constitutes permission (except where prohibited) for the Sponsor to use the Winner’s name, photograph, likeness, statements, biographical information, voice and address (city and state) for any and all public relations, advertising and/or promotional purposes as determined by Sponsor, in all forms of media and by all manners (now and hereafter known), in perpetuity, without notice, consent, review or approval or further compensation. The sweepstakes giveaway is in no way sponsored, endorsed, administered by, or associated with Facebook, X (i.e.Twitter), Instagram, Snapchat, YouTube, Reddit, Pinterest, LinkedIn or any other social networks that are used to share the Sweepstakes. You understand that you are providing your information to the owner of the Sweepstakes and not to Facebook, X, Instagram, Snapchat, YouTube, Reddit, Pinterest, LinkedIn or any other social networks.

IX. MODIFICATION: In no event will Sponsor be obligated to award more prizes than the number of prizes stated in these Official Rules. If for any reason Sponsor determines, in its sole discretion, that the Sweepstakes is no longer capable of running as intended by these Official Rules for any reason whatsoever, Sponsor reserves the right to terminate, suspend, postpone, delay or modify the Sweepstakes, in whole or in part, including, but not limited to, any occurrences described in section VIII, or any other causes which may corrupt or impair the integrity, security, fairness or proper conduct of the Sweepstakes.  If Sponsor determines that more prize claims are submitted or more prize notices are distributed than the number of prizes offered in these Official Rules, Sponsor shall immediately suspend all drawings and prize awards, and Sponsor reserves the right to award any remaining prizes (up to the total set forth in these Official Rules) in a manner deemed fair and equitable by Sponsor. For example, Sponsor may select a winner in a random drawing from among the eligible entries received up to the time of the impairment or conducted a random drawing among all prize claimants, and neither Sponsor nor any of the Released Parties shall have any further liability to any Participant in connection with the Sweepstakes.

VIII. LIMITATIONS OF LIABILITY: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON OR PERSONS RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. Released Entities are not responsible for faulty, incorrect, undeliverable or mis-transcribed phone/e-mail/internet transmissions, incorrect announcements of any kind, technical hardware or software failures of any kind including any injury or damage to any person's computer related to or resulting from participating in or experiencing any materials in connection with the Promotion, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmission that may limit a Participant’s (or user's) ability to participate in the Promotion. Sponsor assumes no responsibility for undeliverable e-mails resulting from any form of active or passive e-mail filtering by a Participant’s Internet service provider and/or e-mail client or for insufficient space in Participant’s e-mail account to receive e-mail. Sponsor reserves the right to cancel or modify the Promotion if for any reason, the Giveaway is undermined by any event beyond the Sponsor’s control, including but not limited to fire, flood, epidemic, labor dispute or strike, act of God or public enemy, or any force majeure event or if fraud, misconduct or technical failures destroy the integrity of the program; or if a computer virus, bug, or other technical problem corrupts the administration or security of the program as determined by Sponsor/it’s agencies, in their sole discretion. In the event of termination, a notice will be posted online and a drawing to award the Prizes will be conducted from among all eligible entries received prior to termination. The failure of the Released Entities to comply with any provision of these Official Rules due to an act of God, epidemic, act of public enemies or any act outside of the Sponsor’s control/force majeure event, will not be considered a breach of these Official Rules. In the event a dispute arises regarding the identity of the Participant, entry will be deemed made by the person whose name appears on the online order form or mail-in entry. Any damage made to the Website by a Participant will be the responsibility of the Participant and/or the authorized e-mail account holder of the e-mail address submitted at the time of entry. Proof of submitting entries will not be deemed to be proof of receipt by Sponsor. Any entries which are suspected of being fraudulent (including those using robotic, automatic, programmed, or similar methods of participation) will be disqualified, based on determinations made solely by Sponsor. Sponsor reserves the right to prohibit the participation of an individual if fraud or tampering is suspected or if the individual fails to comply with any requirement of participation as stated herein or with any provision in these Official Rules.

IX. RELEASES: All Participants, as a condition of participation in this Sweepstakes, agree to indemnify, release and hold harmless Sponsor and Released Entities from and against any and all liability, claims, damages, injuries or actions of any kind whatsoever for injuries, damages, or losses to persons or property which may be sustained in connection with: (a) accessing the Sponsor's Website; (b) participating in any aspect of the Sweepstakes, including, without limitation, while preparing for, participating in and/or traveling to or from any prize or Sweepstakes-related activity, including, without limitation, any injury, damage, death, loss or accident to person or property; (c) the receipt, ownership, possession, use or misuse of any Prize awarded; (d) viruses or any downloading or other problems with the Sweepstakes Application, or; (e) any typographical or other error in these Official Rules or the announcement of offering of any Prize. Sponsor makes no representations or warranties of any kind concerning the appearance, safety or performance of any Prize, except for any express manufacturer's warranty as may be included with the Prize. Prize Winner bears all liability and risk of loss or damage to his/her respective Prize after it has been delivered. 

X. GOVERNING LAW/DISPUTES: Except where prohibited, as a condition of participating in this Promotion, Participant agrees that any and all disputes which cannot be resolved between the parties, claims and causes of action arising out of, or connected with this Promotion, or any prizes awarded, or the determination of Winner shall be resolved individually (without resort to any form of class action and with the understanding and agreement that these Official Sweepstakes Rules shall apply), and shall be submitted to arbitration pursuant to the commercial arbitration rules of the American Arbitration Association, then effective. Further, in any such dispute, under no circumstances will Participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, or any other damages, including attorneys' fees, other than Participant’s actual out-of-pocket expenses (e.g., costs associated with entering this Promotion), and Participant further waives all rights to have damages multiplied or increased. The arbitration shall be conducted in the State of Missouri, in the City of St Louis, and judgment on the arbitration award may be entered into any court having jurisdiction thereof. In the event that arbitration is prohibited in a particular state/territory then any such claim shall be brought and maintained in the federal or state courts of the State of Missouri, in Jefferson City. Any dispute or claim arising out of the entry of this Sweepstakes, or any disputes with site users which arise, as a result of the use of this website, shall be governed by the laws of the State of Missouri, without respect to conflicts of laws principles. 

XI. OFFICIAL SWEEPSTAKES RULES REQUEST: For a copy of these Official Rules, send a request specifying Official Rules along with a self-addressed, stamped envelope postmarked by February 20, 2025 and received by February 25, 2025 and mail to: Compliance / Webcorp Official Rules, Box 469   Stonington, CT  06378. 

XII. WINNERS LIST REQUEST: To request confirmation of the name and city/state of residence for the prize winner, please send a self-addressed, stamped business size envelope, by February 25, 2025, to:  Compliance / Webcorp Sweepstakes Winners List, Box 469   Stonington, CT  06378. Requests received after February 25, 2025 will not be acknowledged or returned.

MISCELLANEOUS: The names of individuals, groups, companies, products, and services mentioned herein, and any corresponding likenesses, logos and images thereof reproduced herein, have been used for identification purposes only and may be the copyrighted properties and trademarks of their respective owners. The mention of any individual, group or company, or the inclusion of a product or service as a prize, does not imply any association with or endorsement by such individual, group or company or the manufacturer or distributor of such product or service and, except as otherwise indicated, no association or endorsement is intended or should be inferred. The invalidity or unenforceability of any provision of these Official Rules or the Prize Acceptance Release will not affect the validity or enforceability of any other provision. In the event, that any provision of the Official Rules or the Prize Acceptance Release is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Sponsor’s failure to enforce any term of these Official Rules will not constitute a waiver of that provision. For Participant, to the extent there is a conflict between Official Rules appearing any other location and any terms of use or other agreements posted on the Sponsor's Website, these are the Official Rules to be abided by.
